Terms of Use.

These Terms of Use (“Terms”) govern your access to and use of the website at elevateyourphotography.com and any related programs, content, courses, communities, and services offered by Elevate Photography Education (“Elevate,” “we,” “us,” or “our”). By using the site or enrolling in any of our programs, you agree to these Terms. If you do not agree, do not use the site or the programs.
Acceptance of terms
You must be at least 18 years old and able to enter into a binding contract to use this site or enroll in any Elevate program. By accepting these Terms, you confirm that you meet those requirements.
Description of services
The site provides marketing pages, free educational content, lead magnets, and information about Elevate 360, a 12-month business education program for portrait and wedding photographers. Paid programs, coaching, courses, and community access are offered separately and may be governed by additional terms that you accept at the time of enrollment.
Intellectual property
All content on this site and within our programs, including text, graphics, photos, video, recordings, slide decks, templates, spreadsheets, and the Elevate branding, is the property of Elevate, its licensors, or Michael Anthony, and is protected by copyright, trademark, and other intellectual property laws.
When you enroll in a paid program, you receive a personal, non-transferable license to access and use the program materials for your own studio. You may not:
- Copy, reproduce, distribute, publish, or display program materials outside the platform we provide them on.
- Share your login credentials, recordings, or materials with anyone who has not paid to enroll.
- Resell, sublicense, or repurpose the materials as part of your own coaching, course, or training offering.
- Use any of our branding, name, or likeness to imply an endorsement or partnership that does not exist.
Your content
If you submit content to us (testimonials, photos, comments, posts in the Inner Circle community, or materials shared during coaching), you grant Elevate a worldwide, non-exclusive, royalty-free license to use, display, and reference that content in connection with operating and promoting our programs. You can ask us to remove specific content at any time by emailing mike@michaelanthonyphotography.com.
Acceptable use
You agree not to:
- Use the site or any program in a way that violates any applicable law or regulation.
- Attempt to gain unauthorized access to any part of the site, our systems, or other students’ accounts.
- Disrupt, interfere with, or impose an unreasonable burden on the site, our community, or other users.
- Use the site or our communities to harass, threaten, or defame any other person.
- Scrape, harvest, or otherwise extract data from the site, our programs, or our community using automated means without our written permission.
Payments and refunds
Pricing for paid programs is stated on the relevant sales or application page and at checkout. By enrolling, you authorize us, directly or through our payment processors, to charge the payment method you provide. Refund and cancellation terms are stated in the enrollment agreement or program-specific terms you accept at the time of purchase. If those terms conflict with these Terms, the program-specific terms control for that program.
Educational nature and results
Elevate 360 is an educational program. We teach the systems Michael Anthony uses in his own studios. Examples, testimonials, and case studies on this site reflect the results of specific students and are not promises or guarantees of any particular result for you. Your results depend on factors we do not control, including your effort, your market, your existing business, and conditions outside the program.
Third-party links and services
The site links to third-party services such as our CRM (HighLevel), community platform (Skool), payment processors, scheduling tools, and YouTube. We are not responsible for the content, terms, or privacy practices of those services. Your use of them is governed by their own terms and policies.
Disclaimers
The site and all content are provided on an “as is” and “as available” basis. To the fullest extent allowed by law, Elevate disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or free of harmful components.
Limitation of liability
To the fullest extent allowed by law, Elevate and its officers, employees, instructors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the site or any program. Our total liability for any claim arising out of or relating to these Terms or your use of the site or programs will not exceed the amount you paid us in the twelve months preceding the event giving rise to the claim, or one hundred US dollars, whichever is greater.
Indemnification
You agree to indemnify and hold Elevate, its officers, employees, instructors, and affiliates harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your use of the site, your violation of these Terms, or your violation of any rights of another.
Termination
We may suspend or terminate your access to the site or any program at any time, with or without notice, if we believe you have violated these Terms or any program-specific terms. Sections of these Terms that by their nature should survive termination will survive, including intellectual property, disclaimers, limitations of liability, and indemnification.
Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or your use of the site or programs will be resolved in the state or federal courts located in Dallas County, Texas, and you consent to the personal jurisdiction of those courts.
Changes to these terms
We may update these Terms from time to time. When we make material changes, we will revise the “Last updated” date above and, where appropriate, notify you by email or through the site. Your continued use of the site or any program after changes take effect means you accept the updated Terms.
